The U.S. Department of Education (the Department) has announced a significant move to escalate its Title IX investigations into the Minnesota Department of Education (MDE) and the Minnesota State High School League (MSHSL).
This shift will elevate both investigations to the Title IX Special Investigations Team (Title IX SIT), which includes both the Department of Education and the U.S. Department of Justice.
This decision follows an event in Minnesota this past weekend when a male athlete from Champlin Park High School competed in a girls’ softball match under the MSHSL, leading the team to a state championship victory.
This raised concerns about the fairness of allowing male athletes to compete in female sports, prompting further investigation.
Title IX Investigations and the Issue of Gender Identity in Sports
In February, the Department of Education’s Office for Civil Rights (OCR) began investigating the MSHSL due to its plans to disregard federal law in favor of state policies that permit student-athletes to participate in sports based on their gender identity.
On June 3, OCR launched a separate investigation into the Minnesota Department of Education after receiving a complaint about policies allowing males to participate in female sports and access female-only facilities.
The U.S. Department of Education expressed concern that these practices may be in violation of Title IX, which protects individuals from discrimination based on sex in educational programs that receive federal funding.
As a result, both investigations are now being handled by the Title IX SIT for a more comprehensive review and faster resolution.
Secretary McMahon’s Statement on Protecting Women’s Rights
U.S. Secretary of Education Linda McMahon commented on the decision, emphasizing the government’s responsibility to protect women and girls in educational environments.
She stated, “Minnesota’s continued indifference to females’ civil rights is completely unacceptable,” underscoring the importance of ensuring fair competition and safeguarding the achievements of female athletes.
Secretary McMahon also noted the Department’s dedication to restoring full antidiscrimination protections under Title IX.
This move is part of a broader effort to highlight and protect women’s rights, especially during June, which the Department of Education has recognized as “Title IX Month.”
This marks the 53rd anniversary of the signing of Title IX into law on June 23, 1972, a landmark piece of legislation that ensured equal educational opportunities for women and girls.
The Title IX Special Investigations Team
In response to numerous complaints, the Department of Education and the Department of Justice established the Title IX Special Investigations Team (Title IX SIT) on April 4.
The team was created to expedite investigations and enforcement of Title IX, which prohibits discrimination based on sex in education programs receiving federal funding.
Title IX, a part of the Education Amendments of 1972, continues to serve as a critical tool in protecting students from sex-based discrimination.
With this new focus on gender identity policies in sports, the Department of Education aims to ensure that Title IX is upheld and that both male and female athletes are given fair opportunities.
